Terms of Service

1. Acceptance of Terms

By accessing or using Gnome's Cauldron of Cards (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Gnome's Cauldron of Cards is an independent web application that allows users to create, edit, and export fantasy-themed item and monster cards for use in tabletop roleplaying games. The Service includes AI-assisted tools for generating card text and images.

3. User Accounts

You must provide accurate information when creating an account and maintain the security of your credentials. You are responsible for all activity that occurs under your account. You may not create more than one account per person.

4. Subscriptions & Billing

Paid plans are processed through Dodo Payments, who acts as merchant of record for all transactions. Subscription fees are billed in advance on a recurring basis.

Plan changes (upgrades or downgrades) take effect as follows:

• Upgrades — the prorated difference for the remainder of the current billing period is charged immediately.
• Downgrades — your higher plan remains active until the end of the current billing period; the lower plan takes effect at the next renewal date. No charge is issued for the downgrade transition.

Cancellation takes effect at the end of the current billing period; access to your paid plan continues until that date.

No cash refunds are issued to your original payment method under any circumstances. Because a free Trial plan is available with no payment required, we encourage you to fully evaluate the Service before upgrading.

Plan limits (cards, images, PDF exports, AI credits) are defined per plan tier and enforced server-side. Exceeding your plan's limits after a downgrade does not result in immediate data deletion — see Section 11 (Data Retention).

5. User Content & Responsibility

You may create and store content ("User Content") using the Service. You retain all rights to your original User Content. By storing content on the Service, you grant us a limited license to host and display that content solely to operate the Service.

You are solely responsible for ensuring that your User Content does not violate any applicable laws, infringe any third-party intellectual property rights, or violate these Terms. We do not review User Content for IP compliance and accept no liability for content you create.

6. Prohibited Content

You agree NOT to create, upload, or store content that:

• Infringes intellectual property rights, including trademarks, copyrights, or trade secrets belonging to any third party.
• Reproduces, copies, or closely imitates proprietary or protected content, including but not limited to official Dungeons & Dragons settings, named characters, named spells, stat blocks, or other material owned by Wizards of the Coast LLC.
• Is illegal, harmful, abusive, threatening, defamatory, or deceptive.
• Violates any applicable local, national, or international law or regulation.

You are responsible for understanding the intellectual property rules that apply to content you create. Using this Service to generate derivative works of protected material does not transfer liability to us.

7. AI-Generated Content

The Service uses third-party AI models to generate card text and images. AI outputs may be inaccurate, incomplete, or inadvertently resemble existing works. You are responsible for reviewing all AI-generated content before use or distribution. We make no representations about the accuracy, originality, or fitness for any purpose of AI-generated outputs.

8. Content Moderation

We reserve the right to remove or modify any User Content at any time, without notice, if we believe it violates these Terms or applicable law. We also reserve the right to suspend or permanently terminate accounts that repeatedly or egregiously violate these Terms.

9. Intellectual Property

The Service itself — including its design, software, branding, and original content — is owned by the operator of Gnome's Cauldron of Cards and is protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of the Service or its components to you.

You retain ownership of original content you create using the Service, subject to the license granted in Section 5.

10. Disclaimer of Affiliation

Gnome's Cauldron of Cards is an independent, fan-made tool and is not affiliated with, endorsed by, sponsored by, or officially connected to Wizards of the Coast LLC, Hasbro Inc., or any official Dungeons & Dragons property in any way. Dungeons & Dragons and related marks are trademarks of Wizards of the Coast LLC. Any references to D&D concepts within user-created content are the sole responsibility of the user who created them.

11. Data Retention

All User Content remains accessible as long as your account is active, regardless of your current plan tier. If your account is downgraded to a lower plan and your stored content (cards or uploaded images) exceeds the limits of that plan, the excess content will not be immediately deleted. However, we reserve the right to delete content exceeding your active plan's limits after a grace period of 90 days, provided we have sent advance notice to the email address associated with your account.

You are encouraged to reduce your stored content to within your plan's limits to avoid data loss. Upgrading your plan restores full access and prevents deletion.

12. Indemnification

You agree to indemnify, defend, and hold harmless the operator of Gnome's Cauldron of Cards, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.

13. Limitation of Liability

To the fullest extent permitted by applicable law, the operator of Gnome's Cauldron of Cards shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including damages arising from User Content, data loss, or service interruption.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid for the Service in the twelve months preceding the claim, or (b) USD $10.

14. Changes to Terms

We may update these Terms at any time. If we make material changes, we will make reasonable efforts to notify you (such as by updating the "Last updated" date at the top of this page or by email). Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

15. Data & Privacy

We collect and process the following personal data to operate the Service: your email address (for authentication and notifications), the card content you create (text, images), and uploaded image files stored in cloud storage. We do not sell your personal data to third parties.

Legal basis: Processing is carried out on the basis of contract performance (to provide the Service you signed up for) and, where applicable, our legitimate interest in operating and improving the Service.

Third-party processors: Your data is processed by the following sub-processors, each of whom maintains their own GDPR compliance and data processing agreements:

• Supabase — database and file storage
• Dodo Payments — payment processing and subscription management
• OpenAI — AI text and image generation (processes prompts and uploaded images)

These processors may store or process data outside the European Union or Serbia. Such transfers are governed by standard contractual clauses or adequacy decisions as applicable.

Your rights (EU/EEA residents — GDPR; Serbian residents — ZZPL): You have the right to access, correct, delete, or export your personal data; to restrict or object to processing; and to withdraw consent where processing is based on consent. To exercise any of these rights, contact us at support@gnomescauldron.com. We will respond within 30 days.

You may delete your account and all associated data at any time by contacting us. Card content and uploaded images will be permanently removed upon verified deletion request.
